What is the DoorDash Illinois Tip Settlement?

A class action lawsuit against DoorDash has been settled for $11 million. The settlement follows an agreement between DoorDash, Inc. and the Illinois Attorney General’s Office. The lawsuit alleged that DoorDash deceived customers into thinking that tips would increase drivers’ pay, while actually using those tips to lower the company’s contribution to drivers’ guaranteed wages.

The settlement resolves these claims and requires DoorDash to maintain a pay structure where consumer tips are not used to reduce the company’s contributions to driver compensation. The lawsuit was based on violations of the Illinois Consumer Fraud and Deceptive Business Practices Act (ICFA).

What is the Total Settlement Amount?

The settlement amount totals $11,250,000.

How Do I Qualify for a Payout?

To qualify for a payout, you must be one of approximately 80,000 DoorDash drivers who made deliveries in Illinois between July 2017 and September 2019 and received tips that were not paid on top of the guaranteed pay for those deliveries.

How Much Can I Get Paid?

Eligible drivers may receive at least $2, plus a proportional share of the settlement, which will be calculated as follows:

$2 + (Dasher Percentage) × (Settlement Amount – Administration Costs – $2 per Claimant)

How Do I File a Claim?

The settlement will create a website with a claim form for eligible class members, but this website is not yet available (as of November 2024). Once the website is live, drivers must complete the claim form online within 60 days of being notified by the settlement administrators.

Eligible drivers will be contacted via email and provided with instructions on how to choose a payment method through the website or by submitting a claim form.

Do I Need Proof to File a Claim?

The settlement does not specify any additional proof requirements beyond completing the claim form and confirming your identity as an eligible driver.
