A $2.75 million class action settlement has been reached in a case involving Ardagh Glass, addressing claims that the company failed to prevent a data breach in 2021 that exposed personally identifiable information.
The settlement benefits individuals whose data was compromised during a criminal ransomware attack on Ardagh Glass’ network between April 23, 2021, and May 19, 2021.
The class action alleges that Ardagh Glass did not adequately safeguard the personal information of its employees and their dependents. The breach is reported to have affected about 5,300 individuals.
Ardagh Glass, a manufacturer of glass and metal packaging based in Luxembourg, has not admitted to any wrongdoing but agreed to pay $2.75 million to resolve the case.
Class members may receive up to $11,000 to reimburse out-of-pocket expenses resulting from the breach, including costs related to fraud, identity theft, professional fees, credit expenses, and other related expenses. Additionally, claimants can receive compensation for up to five hours of lost time at a rate of $25 per hour.
After reimbursing expenses, the settlement administrator will distribute remaining funds as pro-rata cash payments to eligible class members. Exact payment amounts are not available at this time.
All class members will also receive three years of free credit monitoring and identity theft protection services, including three-bureau monitoring and $1 million in identity theft insurance.
Ardagh Glass has agreed to strengthen its data security practices, which includes enhancing cybersecurity training, policies, monitoring, response measures, and other security protocols.
