First Advantage has settled a class action lawsuit regarding allegations that they did not obtain proper consent from consumers before conducting background checks. The lawsuit claims that First Advantage provided background reports to certain potential employers without first securing authorization from the job applicants. This settlement aims to address the issue by offering benefits to those affected.
The settlement does not include monetary compensation but offers discounts on First Advantage’s “Instant Check” and “Resume Check” services, along with nine free full file disclosures as part of the settlement agreement.
First Advantage is a consumer reporting agency that supplies background screening information to employers and the multi-family housing sector.
To qualify, you must be a consumer whose background report was provided to a potential employer by First Advantage between August 17, 2012, and November 20, 2020, without your explicit prior authorization.
Eligible class members may receive a $15 discount on both the Instant Check and Resume Check services, in addition to nine free full file disclosures.
You may have received a notice or promo code to access these settlement benefits:
A full file disclosure provides background information about an individual as recorded in First Advantage’s databases, allowing consumers to see all available information about them.
According to First Advantage, they do not maintain a permanent “consumer file” on individuals, but may have data including:
Class members generally do not need to file a claim. If First Advantage’s records indicate that you are a member of this class action, you will receive a notice with discount codes, which can be used to access the discounted products.

Under the Fair Credit Reporting Act (FCRA), you are entitled to one free copy of your consumer file from First Advantage every 12 months. Additionally, you may obtain a free copy if:
