What is the Uber Class Action Lawsuit About?
The New York Attorney General has reached a settlement with Uber and Lyft following allegations of unfair practices towards their drivers. The investigation revealed that Uber’s policies resulted in withheld earnings and denied benefits, violating New York labor laws. The settlement includes $290 million in back pay for drivers and the introduction of new measures, such as a minimum earning floor, paid sick leave, proper hiring and earnings notices, and other improvements to driver working conditions.
Attorney General Leticia James highlighted that Uber and Lyft have systematically deprived their drivers of substantial pay and benefits despite their long hours and challenging conditions. For more information about the Lyft Settlement, please refer to the provided link.
How Do I Qualify For A Payout?
You may qualify for reimbursement if you completed at least one trip using the Driver app between November 10, 2014, and May 22, 2017, in New York state.
What Can I Get?
Uber has agreed to establish a $290 million settlement fund to reimburse eligible drivers who submit valid claims. The New York State Attorney General’s Office will determine the payment amounts based on the information provided by Uber and the defendants.
The settlement also introduces new benefits for current Uber drivers, including:
- Sick Leave: Accumulate one hour of sick pay for every 30 hours worked, with a maximum of 56 hours per year. This benefit will start no later than February 29, 2024. Sick leave pay rates will vary depending on whether you drive within or outside the New York City metropolitan area.
- Minimum Payments for Non-NYC Drivers: Drivers outside New York City, not subject to TLC regulations, will receive a minimum hourly rate, starting at $26 per hour from February 29, 2024, with planned increases.
- Training Compensation: Receive compensation for up to one hour of training at a rate of $15 per hour or the local minimum wage, whichever is higher.
