$3,750,000 TransAm Trucking Class Action Settlement

Proof Required: No

What is the TransAm Trucking Class Action Settlement?

A $3.75 million class action settlement has been reached with TransAm Trucking over allegations that the company failed to compensate drivers at least the federal minimum wage ($7.25 at the time) for all hours worked, including orientation sessions for new drivers. Founded in 1987, TransAm Trucking is a large freight carrier based in Kansas, servicing most of the continental U.S.

TransAm denies the allegations and asserts that it has always compensated its employees correctly and legally. While the court has preliminarily approved the settlement, this does not confirm the validity of the claims made in the lawsuit. TransAm states that its compensation practices comply with the law and that the decision to settle was made to avoid prolonged litigation, allowing the company to focus on its business and the well-being of its employees and customers. This settlement is a practical decision, not an admission of wrongdoing.

How Do I Qualify for a Payout?

To qualify for a payout from the TransAm Trucking class action settlement, you must meet at least one of the following criteria:

  1. Company Driver Orientation Claim: If you attended orientation in Texas or Florida between October 2020 and March 2021, you may be eligible due to alleged underpayment during this period, violating the Fair Labor Standards Act (FLSA).
  2. Lease Driver Minimum Wage Claim: If you were misclassified as an independent contractor and did not receive minimum wage while driving for TransAm, you may qualify under this claim.
  3. Truth-in-Leasing Claim: If you were subject to a TransAm independent contractor agreement that failed to clearly disclose all deductions from your compensation, you may be eligible for this claim.

How Much Can I Get?

Payouts will vary depending on which category you qualify for:

  • Company Driver Orientation Claim: Minimum payout of $35 per eligible individual, with a total settlement fund of $125,000. Eligible if you attended orientation in Rockwall, TX, or Tampa, FL, between October 2020 and March 2021, with funds distributed equally among valid claimants.
  • Lease Driver Minimum Wage Claim: Total fund of $700,000, with a minimum payout of $8.00 per week for lease drivers. Eligible if you drove for TransAm under an independent contractor agreement since September 29, 2020.
  • Truth-in-Leasing Claim: Total fund of $1,311,000, with a minimum payout of $8.75 per week for lease drivers. Eligible if you had a TransAm independent contractor agreement with deductions since February 2017.

All funds from the nearly $4 million settlement will be distributed to qualifying class members, with no money returning to TransAm Trucking. Any unclaimed funds will be redistributed among those who submit valid claims by the deadline of August 23, 2024.
