What is the P.C. Richard & Son Class Action Settlement?
A class action lawsuit totaling nearly $5 million has been settled with P.C. Richard & Son. The lawsuit alleged that P.C. Richard & Son violated the Fair and Accurate Credit Transactions Act (FACTA) by printing credit/debit card expiration dates on receipts.

How Do I Qualify for a Payout?
To qualify, you must have used a personal American Express (AMEX) credit or debit card at a P.C. Richard & Son store in the United States between November 12, 2015, and August 18, 2016, and received a printed receipt showing your card’s expiration date.

The settlement fund amounts to $4.9 million. If you qualify, you could receive up to $1,000, pending final approval of the settlement. P.C. Richard & Son has also agreed to implement a new policy that limits printed card information to only the last five digits of the card number, excluding the expiration date.

How Do I File a Claim?
If you received a notice with a Claim Number starting with “A,” you are already an Eligible Settlement Class Member and do not need to take further action to receive your payment, up to $1,000, pending final settlement approval.

If your notice number starts with “P,” indicating you made transactions with an AMEX card but it’s unclear if it was a personal or business card, you must submit a Short-Form Claim Form to confirm the transaction was made with a personal AMEX card.

If you did not receive any notice, you must complete and submit a Claim Form-R to become an Eligible Settlement Class Member and potentially receive up to $1,000.

Do I Need Proof to File a Claim?
Yes, proof of your transaction is required. If you are submitting a Claim Form-R, you can provide proof in one of two ways:

  • Option 1: Attach an original or copy of your receipt showing the AMEX card’s expiration date and a transaction at P.C. Richard & Son during the specified period.
  • Option 2: Attach an original or copy of your AMEX statement showing a transaction at P.C. Richard & Son within the same period. Ensure to redact sensitive information, such as account numbers, leaving only your name, address, and transaction details visible.

You may submit only one claim, regardless of the number of eligible transactions. If sending original documents, keep copies for your records, as the settlement administrators are not responsible for lost originals.
