A $700,000 settlement has been reached with Henry Ford Health System to address claims that the organization failed to adequately protect patients from a data breach in 2023.

This settlement will benefit consumers who received a written notification from Henry Ford indicating that their information might have been compromised due to a cyber incident on March 30, 2023.

According to the plaintiffs in the class action lawsuit, Henry Ford Health System should have taken reasonable cybersecurity precautions to safeguard patient information. The breach reportedly affected the names, medical records, contact details, and other data of approximately 168,000 patients.

Henry Ford Health System, an academic medical center based in Michigan, has not admitted any wrongdoing but has agreed to pay $700,000 to settle the lawsuit.

As part of the settlement, class members may claim up to $2,500 for documented expenses related to the data breach, or receive a pro rata cash payment, which will vary based on the total number of claims submitted. While proof of damages is required for reimbursement, no proof is necessary for the pro rata payment.

All class members, regardless of their payment choice, will receive one year of free credit monitoring from two credit bureaus and $1 million in identity theft insurance. This benefit is available even if they previously utilized Henry Ford’s offered credit monitoring services.

The deadline to exclude oneself from the settlement or to file objections was September 28, 2024. A final approval hearing is set for October 29, 2024.

To obtain benefits from the Henry Ford Health System settlement, class members must submit a valid claim form by October 28, 2024.
