How to File a Claim

The original lawsuit was filed against RCN Telecom on behalf of customers who were charged late fees on their broadband internet service between August 12, 2014, and April 25, 2022. Consumers alleged that RCN imposed late fees that were inconsistent with their terms and conditions and violated New Jersey law, including the New Jersey Consumer Fraud Act.

Who Qualifies?

All current and former customers in the United States who received internet services from RCN and paid late fees between August 12, 2014, and April 25, 2022, are eligible for this settlement.

Potential Payout

Class members who were charged late fees for broadband internet service and submit valid claims will have the option to receive either a bill credit (if they are still customers at the time of payout) or a check/electronic payment from the $6.65 million settlement fund. The payout amount for each qualified claimant will depend on:

  • Whether they choose a bill credit or a check/electronic payment
  • Their subscription period
  • The total number of claimants (payouts will be pro-rated)

Current customers opting for a check or electronic payment, as well as former customers, will receive 50% of their allocated late fees. The allocated loss is calculated based on the following criteria:

  • Customers who signed up after February 17, 2019, will receive 80% of their late fees.
  • Customers who signed up before February 17, 2019, and were customers thereafter will receive 40%.
  • Former customers who signed up before February 17, 2019, and were not customers afterward will receive 20%.

How to File a Claim

To receive reimbursement, you needed to submit a claim form online by August 23, 2022.

A final approval hearing was held on July 29, 2022, at 9 AM Eastern Time via Zoom.
