What is the Blue Cross Blue Shield Provider Settlement?

Blue Cross Blue Shield (BCBS) has reached a $2.8 billion settlement in a class action lawsuit that addresses allegations of antitrust violations in their dealings with healthcare providers. The lawsuit claimed that BCBS, through the Blue Cross Blue Shield Association and individual Blue Plans, divided the U.S. into exclusive “Service Areas” and agreed not to compete in those areas, while also fixing prices for services.

BCBS denies any wrongdoing, and the settlement is made to avoid further litigation costs and uncertainty. It should be noted that this settlement does not imply any legal violations by BCBS, and the Court has not determined fault. Instead, both parties agreed to settle to avoid the expense and unpredictability of a trial.

There are two types of claims that providers can submit:

  • Facility Claims: These are claims submitted by healthcare facilities such as hospitals, nursing homes, and clinics for services rendered to patients. These claims typically cover inpatient and outpatient care, equipment use, and treatments.
  • Professional Claims: These claims are submitted by individual healthcare providers, such as doctors, nurses, and therapists, for services they directly provided to patients, including consultations, procedures, and treatments.

The key difference between the two is that facility claims pertain to institutional services, while professional claims are for services rendered by individual providers.

Who Can Participate in the BCBS Settlement?

Yes, this settlement is only for healthcare providers, which includes:

  • Hospitals, clinics, nursing homes, and other healthcare facilities (filing Facility Claims).
  • Doctors, nurses, therapists, and other individual healthcare professionals (filing Professional Claims).

To be eligible, you must have provided services to BCBS members between July 24, 2008, and October 4, 2024. If you meet these criteria, you may be able to submit a claim and receive a share of the $2.8 billion settlement.

What is the Total Settlement Amount?

The settlement amount is a significant $2.8 billion.

How Do I Qualify For a Payout?

You may qualify for a payout if you provided healthcare services to BCBS members between July 24, 2008, and October 4, 2024, and are not excluded from the settlement class.

How Much Can I Receive?

The payout amount varies based on the provider type and the amount of services rendered. Payments will be made from the Net Settlement Fund, which is divided into two parts:

  1. Monetary Settlement: A total of $2.8 billion will be distributed to eligible healthcare providers. The fund will be split as follows:
    • 92% will go to healthcare facilities.
    • 8% will go to medical professionals.
  2. Injunctive Relief: This part involves changes to BCBS’s business practices to foster more competition and improve provider interactions, including:
    • Overhaul of the BlueCard Program.
    • Commitment to prompt payments and improved service level agreements.
    • Changes to contract rules, better technical capabilities, and enhanced information sharing.
    • Expansion of opportunities for value-based contracts.

These measures aim to provide both immediate financial compensation and long-term improvements to the healthcare system.
