Houser LLP $1.3 Million Data Breach Class Action Settlement



Houser LLP has agreed to pay $1,300,000 to settle a class action lawsuit related to a data breach that occurred between May 7 and May 9, 2023. The breach allegedly exposed sensitive personal information belonging to customers of Houser’s clients. The lawsuit claims the firm failed to maintain adequate data security measures.

Who Is Eligible?

You may be eligible to file a claim if:

  • You received a notification letter from Houser LLP beginning around February 28, 2024, informing you that your private information was impacted or potentially accessed in the breach.
  • You fall into one or more of the following groups:
    • General Class: Any individual whose data may have been exposed in the breach.
    • California Subclass: California residents whose information was affected.
    • Washington Subclass: Washington State residents whose information was affected.

Settlement Payment Options

Eligible claimants may choose one or more of the following benefits:

  • $50 cash payment for all class members.
  • Additional $25 for Washington residents.
  • Additional $100 for California residents.
  • Reimbursement for out-of-pocket losses, up to $5,000. To qualify, these losses must:
    • Be reasonably linked to the data breach.
    • Have occurred on or before May 7, 2023.
    • Be supported by documentation.
    • Not have been reimbursed from another source.
    • Include examples such as credit monitoring fees, bank charges, or fraud-related expenses.

To receive compensation, class members must submit a claim form by October 1, 2025.

Settlement Fund Details

  • Claimant payments: Remaining funds distributed to approved claimants

When Will Payments Be Issued?

Payments to class members with approved claims will be issued approximately 90 days after the court grants final approval of the settlement or once claim processing is completed.

Reason for the Lawsuit

This settlement resolves allegations that Houser LLP failed to implement reasonable data protection practices, allowing a cyberattack to expose personal information. Plaintiffs argued this resulted in a violation of privacy and potential identity theft risks. Houser has denied any wrongdoing but agreed to settle to avoid further legal proceedings.
