PurFoods $4.25 Million Data Breach Class Action Settlement


Overview
PurFoods LLC has agreed to a $4.25 million settlement to resolve a class action lawsuit over a cyberattack that occurred between January 16, 2023, and February 22, 2023. Individuals who received notice that their personal information may have been compromised may be eligible to claim up to $5,000.

Who is eligible to file a claim?
You may be eligible if:

  • You reside in the United States
  • You received a notice from PurFoods LLC in August or September 2023 indicating your personal information may have been accessed or compromised in the data incident
  • You were a customer, employee, or independent contractor of PurFoods

Approximately 1,249,219 individuals are included in the settlement class.

What can class members receive?

Documented loss payment:
Up to $5,000 for out-of-pocket losses directly related to the data breach. Covered expenses include:

  • Fraud or identity theft-related losses
  • Professional service fees (legal, accounting, credit repair)
  • Fees for freezing/unfreezing credit
  • Unreimbursed bank fees
  • Postage or printing expenses
  • Gasoline for local travel

Cash award (no documentation required):
A pro rata cash payment for those without documented losses. The estimated amount is around $75 but could be higher or lower depending on the number of claims. The maximum per person is $5,000.

Credit monitoring and insurance services:
Three years of three-bureau credit monitoring and $1 million in identity theft insurance are available to all claimants, regardless of whether they also receive a cash award or reimbursement.

Claims can be submitted online or by mail. The deadline to submit a claim is October 30, 2025.

Is documentation required?

  • For documented losses: Submit receipts or third-party documentation clearly showing the loss and connection to the breach. Handwritten receipts alone are not acceptable.
  • For credit monitoring or cash award: No documentation is required; simply select the desired option on the claim form.
  • All claimants must provide the class member ID from their settlement notice.

Settlement fund allocation

The $4.25 million fund will cover:

  • Settlement administration costs: $510,000
  • Attorneys’ fees: $1,416,525
  • Attorneys’ costs: To be determined
  • Service awards: Up to $2,500 for each class representative
  • Credit monitoring: Cost depends on number of claims submitted
  • Payments to eligible class members: Remaining funds

When will payments be issued?
Payments are expected to be sent approximately 30 days after the court gives final approval to the settlement and any appeals have been resolved.

Why did this settlement happen?
The lawsuit alleged that PurFoods LLC failed to properly safeguard the personal information of customers, employees, and contractors during a cyberattack. The exposed data may have included names, addresses, Social Security numbers, health information, and more.

PurFoods denies any wrongdoing but agreed to settle in order to avoid further litigation and related expenses.
