Overview
Patients notified that their personal information was exposed in the October 2023 data breach involving Neuromusculoskeletal Center of the Cascades PC and Cascade Surgicenter LLC may be eligible to claim up to $2,500 as part of a class action settlement.
The settlement resolves a lawsuit alleging that the organizations failed to protect sensitive personal and medical information from a cyberattack. The breach resulted in unauthorized access to patient data, including names, Social Security numbers, financial account details, and medical records.
Who Can File a Claim?
Eligible class members include individuals who:
- Received written notification from either Neuromusculoskeletal Center of the Cascades PC or Cascade Surgicenter LLC
- Were informed that their personal data was compromised in the October 2, 2023 data incident
What Are the Settlement Benefits?
Claimants can choose between two options:
Option 1: Comprehensive Relief (may submit claims for any or all of the following)
- Medical Data Monitoring Services
Two years of CyEx Medical Shield Total, which includes:- $1 million in medical identity theft insurance
- Monitoring for exposure of health insurance IDs, medical record numbers, and unauthorized health savings account activity
- Out-of-Pocket Expenses (up to $500)
Reimbursement for documented expenses related to the breach, such as:- Credit monitoring or reports
- Freezing or unfreezing credit
- Replacing identification documents
- Postage or other communication expenses with financial institutions
- Identity Theft or Fraud Losses (up to $2,500)
For documented losses traceable to the breach that are not already reimbursed. Claimants must show attempts to recover the loss through credit card companies, banks, or insurers. - Lost Time (up to $100)
Reimbursement for up to four hours of time spent addressing issues caused by the breach, at $25 per hour.
Option 2: Flat Cash Payment
- A one-time $80 payment is available for those who do not claim any of the Option 1 benefits.
How to File a Claim
To receive a payment, class members must submit a completed claim form by the deadline of December 26, 2025. Claim forms can be submitted:
- Online through the official settlement website
- By mail using a printed PDF claim form
- By email (a scanned or photographed image of the completed form)
