Consumers who received marketing text messages from Bishop Gold Group LLC after requesting not to receive further communications may be eligible for a cash payment under a $2 million class action settlement.
Bishop Gold Group LLC agreed to resolve claims that it violated the Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA) by continuing to send text messages to individuals who had opted out.
Eligibility Criteria
To qualify for a payment, individuals must meet all of the following conditions:
- Received more than one marketing text message from Bishop Gold Group LLC within a 12-month period.
- Previously asked Bishop Gold Group LLC to stop sending messages (such as replying “stop” or “unsubscribe”).
- Did not re-consent to receive messages before receiving additional ones.
- Received the messages while located in the United States.
- Received the messages during the four years prior to the filing of the lawsuit.
Settlement Payout Details
The total settlement fund is $2,000,000. From this amount, deductions will be made for:
- Attorneys’ fees (up to $666,000)
- Legal expenses
- Administrative costs
- A service award of up to $7,500 to the class representative
The remaining amount will be divided pro rata among eligible claimants who submit valid and timely claims. This means each claimant will receive an equal share of the net settlement fund, depending on the number of approved claims.
