
Consumers who purchased certain Mid America Pet Food products may be eligible to receive up to $100,000 from a class action settlement.
Overview
Individuals who bought specific Mid America Pet Food products between October 31, 2022, and February 29, 2024, may file a claim for compensation. Mid America Pet Food agreed to pay $5.5 million to resolve claims that it marketed and sold pet food products potentially contaminated with salmonella, which can cause serious illness or death in pets.
Eligible brands include Victor Super Premium, Wayne Feeds, Member’s Mark and Eagle Mountain.
Who Is Eligible?
You may be part of the settlement if:
- You lived in the United States and purchased one or more qualifying Mid America Pet Food products listed in Exhibit D of the settlement agreement.
- The products you purchased were included in the recalls announced on September 3, 2023, October 30, 2023, or November 9, 2023.
- You bought the products between October 31, 2022, and February 29, 2024.
There are two types of claims:
- Pet injury claims: For pets that became ill or died after consuming recalled food.
- Consumer food purchase claims: For purchasing the recalled food, whether or not a pet was harmed.
Breeders may also submit claims for losses related to their breeding business, with additional documentation.
Who Is Excluded?
Those who bought Mid America pet food products for resale are not eligible.
Settlement Payment Amounts
Class members may submit a claim for one or both categories:
Pet injury claims:
- Documented claims: 100% reimbursement of approved losses, up to $100,000, with veterinary records or other documentation.
- Undocumented claims: Up to $50 for pets that became ill, or up to $100 for pets that died.
- Breeders: Up to $100,000 for documented losses with required business records.
Consumer food purchase claims:
- With proof: 100% reimbursement of the purchase price of qualifying pet food.
- Without proof: $20 per bag for up to two bags (maximum $40).
Claims may be reduced proportionally if total valid claims exceed the net settlement fund. Claims over $5,000 must be approved by the settlement administrator and class counsel.

Each household may submit only one consumer food purchase claim and/or one pet injury claim.
Required Information
Pet injury claims (documented):
- Receipts, invoices, veterinary records or other evidence of illness or loss.
- Breeders must also submit business proof such as sales records, profit and loss statements, tax records, and a valid commercial license or permit from the time of the incident.
Pet injury claims (undocumented):
- A signed declaration describing the illness or death.
Consumer food purchase claims (documented):
- Product name, purchase date, purchase location (store/city/state or website) and proof of purchase such as receipts or loyalty card records.

Settlement Fund Breakdown
The $5.5 million settlement fund covers:
- Settlement administration costs (to be determined)
- Attorneys’ fees: up to $1,833,150
- Attorneys’ expenses: up to $35,000
- Service awards for plaintiffs: at least $5,000 for those who rejected prior offers; up to $5,000 for others
- Documented pet injury and consumer purchase claims: up to $1,500,000
- All other approved claims: remaining funds

Payout Timeline
Payments will be issued after claim processing is completed and the court grants final approval of the settlement.
Reason for the Settlement
The lawsuit claimed that Mid America Pet Food sold products contaminated with salmonella. The company denies wrongdoing but agreed to settle to avoid the cost, risk and uncertainty of further litigation.
