Trinity Health $450,000 Data Breach Class Action Settlement

Individuals who received a data breach notice from Trinity Health Corp. addressed to a California residence may be eligible to claim up to $1,000 for out-of-pocket losses plus a pro rata cash payment from a class action settlement.

Trinity Health Corp. agreed to pay $450,000 to settle a lawsuit alleging it failed to protect patient and consumer data during a January 20, 2021 data breach involving the Accellion File Transfer Appliance. The compromised information may have included names, addresses, emails, dates of birth, health care provider details, medical information, Social Security numbers, credit card data, and claims information.

Who Is Included in the Settlement?

Class members must meet all of the following:

  • They received a direct mail notice from Trinity Health Corp. about the January 2021 data incident.
  • The notice was addressed to a California address.
  • Their data may have been impacted.

Approximately 18,153 California residents are included in the settlement.

How Much Can Class Members Receive?

Class members who submit a timely and valid claim form may receive both:

1. A pro rata cash payment

Actual amounts depend on participation.

2. Up to $1,000 for documented out-of-pocket losses, such as:

  • Losses from identity theft or fraud
  • Card replacement or cancellation fees
  • Credit monitoring or credit report fees
  • Costs to freeze or unfreeze credit
  • Replacement fees for government-issued IDs
  • Bank fees tied to fraud, such as overdraft or returned check fees

If verified out-of-pocket claims exceed available funds, payments may be reduced proportionally.

If funds remain more than 120 days after initial payments, a second distribution may occur for class members who cashed their checks—if the average additional payment would be at least $10. Any remaining amount after the second distribution will go to the designated nonprofit recipient.
