Employees who worked overtime for National Lutheran Inc. between October 11, 2021, and December 6, 2024, may be eligible to receive a payment from a class action settlement.

Current and former nonexempt employees of National Lutheran Inc. or its affiliates in Virginia, Maryland, or Pennsylvania who worked overtime during the covered period may qualify for a cash payment ranging from approximately $1.53 to $6,283.65. The company agreed to pay $289,530.29 to resolve allegations that it miscalculated overtime wages by failing to include shift differentials, nondiscretionary bonuses, and other incentive pay.

Who Is Included in the Settlement?

Class members are nonexempt employees who:

  • Worked in Virginia, Maryland, or Pennsylvania
  • Worked for National Lutheran Inc. or its affiliates between October 11, 2021, and December 6, 2024
  • Worked overtime during that period
  • Have at least $1 in calculated unpaid overtime wage damages

Payment Amounts

The total available to class members is $170,000.04, distributed on a pro rata basis according to each individual’s share of total alleged damages.

  • Payments are split evenly between overtime backpay (reported on a W-2) and liquidated damages (reported on a 1099).
  • The smallest payment is $1.53; the largest is $6,283.65.

Why This Settlement Occurred

The lawsuit alleged that National Lutheran Inc. failed to properly calculate overtime pay by excluding certain forms of incentive compensation. Although the company denies the allegations, it agreed to settle to avoid further litigation.
