What is the Airline Class Action?
A $60 million class action settlement has been established over allegations that major U.S. airlines colluded to unfairly inflate ticket prices. Travelers who bought domestic airline tickets between July 1, 2011, and June 14, 2018, may be eligible for compensation if they flew with any of the following airlines:

  • American Airlines, Inc.
  • Delta Air Lines, Inc.
  • Southwest Airlines Co.
  • United Airlines, Inc.

Current Status of the Domestic Airlines Class Action
The case’s status remains pending. In 2021, United Airlines and Delta Air Lines sought to dismiss the case through summary judgment, but on September 12, 2023, the court denied their request, allowing the case to proceed. This development benefits the class action lawsuit.

Settlement Funds from Other Airlines
Settlement funds from American Airlines and Southwest Airlines are currently held in escrow. These funds will not be distributed until the case against United and Delta is fully resolved, whether through settlement, dismissal, or a final trial judgment.

Who is Excluded from the Airline Settlement?
Exclusions from the settlement include not only the judges overseeing the case but also court staff, law clerks, and other personnel involved in the litigation, as they are considered “agents” of the judges.

The lawsuit alleges that American, United, Delta, Southwest, US Airways, and Continental Airlines engaged in price-fixing for tickets. The airlines allegedly conspired to artificially raise fares by intentionally limiting flight capacity, resulting in inflated ticket prices. The settlement still awaits resolution for the remaining airlines involved in the $60 million fund.

Why the Delay in the Airlines Class Action Settlement?
Currently, settlement funds from American Airlines and Southwest Airlines, minus court-approved notice costs, are in escrow. These funds will remain in escrow until United and Delta either settle, are dismissed, or receive a favorable judgment, which would prevent them from contributing additional funds to the $60 million settlement.

How Do I Qualify?
To qualify for the domestic airline settlement, you must meet the following criteria:

  • Purchased air passenger transportation services for flights
  • Within the U.S., its territories, or the District of Columbia
  • From the defendants or their predecessors, including US Airways and Continental
  • Between July 1, 2011, and June 14, 2018

What Can I Get?
Southwest Airlines has agreed to contribute $15 million, and American Airlines has agreed to contribute $45 million to this settlement. The exact amount each eligible claimant will receive is currently unknown. To receive a payment, you will need to submit a valid claim form once the claims period begins.
