What is the Kia Hyundai Settlement About?
A $145 million class action settlement has been reached with Hyundai Motor America and Kia Motors over allegations that certain car models from 2011 to 2022 lacked engine “immobilizer” software, making them more vulnerable to theft. The lawsuit claims Hyundai failed to equip these vehicles with adequate anti-theft measures, leading to higher theft rates and property damage. How Do I Know If I Qualify?
To qualify for a payout from the Kia/Hyundai theft class action settlement, you must have purchased or leased one of the affected Hyundai vehicles in the United States. Vehicles in Puerto Rico, U.S. Virgin Islands, and Guam are not eligible for the free software upgrade. Additionally, certain years of Hyundai models in the contiguous U.S., Alaska, and Hawaii may also be excluded.
You do not need to have experienced theft or attempted theft to qualify. If you own or lease an eligible vehicle, you may still be eligible for a free software upgrade or other benefits such as cash payouts.
Reimbursement Details:
- Software Upgrade: If you received a software upgrade, you can claim up to $250 for lost income or childcare expenses incurred during the upgrade process.
- Key Fob Purchases: Reimbursement is available for up to $350 per key fob (up to two per vehicle) if purchased following Hyundai dealer instructions for the upgrade.
- Steering Wheel Lock: Claim up to $50 for a steering wheel lock purchased at least 30 days before the software upgrade became available for your vehicle.
If your vehicle is not eligible for the software upgrade, you can claim up to $300 for a steering wheel lock, glass breakage alarm, or similar anti-theft system. If you have already received a steering wheel lock from Hyundai, you can claim up to $250 for a glass breakage alarm or other anti-theft modifications.
How Much Can I Get Paid?
The settlement provides various benefits:
Common Fund Benefits for All Class Members:
- Reimbursement up to 60% of the Black Book value of the vehicle for total loss due to qualifying theft or attempted theft.
- Up to $3,375 or 33% of the Black Book value (whichever is greater) for vehicle damage or lost personal property from qualifying theft or attempted theft.
- Up to $375 for insurance deductibles or increased premiums due to qualifying theft or attempted theft.
- Up to $250 for other out-of-pocket expenses due to a qualifying theft or attempted theft.
- Up to $250 for lost income or childcare costs related to obtaining the software upgrade.
For Vehicles Eligible for the Software Upgrade:
- Reimbursement for key fob purchases up to $350 each (maximum of two per vehicle) if purchased for the software upgrade.
- Up to $50 for a steering wheel lock purchased at least 30 days before the software upgrade became available.
For Vehicles Not Eligible for the Software Upgrade:
- Up to $300 for purchasing a steering wheel lock, glass breakage alarm, or similar anti-theft system.
How Do I File a Claim and Get Paid?
To receive a payment from the $145 million class action settlement fund, you must submit a valid claim form by January 11, 2025. Claims can be submitted by mail or online.
