What is the $6 Million BMW Fraudulent Emissions Class Action?
The $6,000,000 class action lawsuit, Rickman v. BMW of North America, alleges that BMW installed a “defeat device” in certain diesel vehicles (2009-2013 BMW X5 xDrive35d and 2009-2011 BMW 335d). This device purportedly reduced emissions controls during normal driving, allowing these vehicles to emit higher pollution levels than what was observed in regulatory testing environments. The lawsuit claims that BMW misled consumers by marketing and selling vehicles with this device.
BMW denies these allegations but has chosen to settle to avoid the costs and uncertainties of prolonged litigation. The court has not yet ruled on the merits of the claims.
What is the Total Settlement Amount?
The total settlement amount is $6 million. This fund will be used to provide cash awards to eligible class members, cover notice and administrative costs, pay attorneys’ fees, and provide service awards to the named plaintiffs, subject to court approval.
How Do I Qualify for a Payout?
To qualify for a payout, you must be a class member who purchased or leased one of the specified BMW vehicles on or before February 28, 2024. The settlement excludes BMW employees, class counsel, judges involved in the case, and individuals who have previously settled or had claims dismissed related to this issue. The vehicles covered under the settlement are:
- BMW X5 xDrive35d
- BMW 335d
How Much Can I Get?
The exact payout amount for each class member is not specified. Cash awards will be distributed pro rata from the Net Settlement Fund, based on the length of ownership or lease of the eligible vehicle. If funds remain after the initial distribution, additional distributions may be made to those who received an initial payment.
