What is the Lyft Drivers Class Action About?
The New York Attorney General Leticia James has disclosed a settlement with Uber and Lyft following allegations of mistreatment towards their drivers. After an extensive multi-year investigation, it was revealed that Uber’s policies resulted in withheld earnings and denied benefits to drivers, violating New York labor laws.
Similarly, Lyft utilized a comparable method to shortchange drivers between 2015 and 2017, deducting an 11.4 percent “administrative charge” from drivers payments in New York, equivalent to the sales tax and Black Car Fund fees owed by riders. Furthermore, both companies neglected to provide drivers with paid sick leave, a benefit mandated by New York City and State laws for employees.
The total settlement fund amounts to $328,000,000, with Uber contributing $290 million and Lyft contributing $38 million. How Do I Qualify For A Payout?
If you used the Lyft Driver app for at least one trip in New York State between October 11, 2015, and July 31, 2017, you could qualify for reimbursement.
What Can I Get?
After discussions, Lyft has consented to establish a $38 million settlement fund, with eligibility for reimbursement open to drivers who submit valid and timely claims.
Current drivers using the Lyft Driver app in New York will receive new benefits, including guaranteed paid sick leave, minimum hourly earnings if driving outside New York City, clearer documentation of earnings, payment for training time, multilingual in-app chat support, the ability to appeal deactivation, and rider payment notifications after each ride.
Paid sick leave accrues at a rate of one hour per 30 hours worked, up to 56 hours per year, and depends on whether drivers operate within or outside the New York City metropolitan area, with rates starting at $17 or $26 per hour respectively, with adjustments for inflation beginning March 1, 2024.
