Overview
A class action settlement totaling nearly $9 million has been reached with Breyers Ice Cream over allegations that some of their vanilla-flavored products were misleadingly marketed. The lawsuit claims that the labeling of Breyers Natural Vanilla Ice Cream suggested it contained only vanilla flavor derived from vanilla beans, when it allegedly included non-vanilla “plant flavors.” While Breyers denies these claims, they have agreed to the settlement to resolve the matter.
Total Settlement Amount
The total settlement is $8.85 million, distributed as follows:
- $1.00 per product purchased with proof of purchase (no limit)
- $1.00 per product purchased without proof of purchase (up to 8 products maximum)
Payment Methods
Eligible class members can choose from several payment methods when filing a claim, including Venmo, Zelle, prepaid digital debit cards, or Amazon gift cards.
Additional Distributions
- A portion of the settlement will cover attorneys’ fees and costs.
- Named plaintiffs may receive service awards.
- Administrative expenses will be drawn from the settlement fund.
Who Qualifies for a Payout?
You may be eligible if you purchased Breyers Natural Vanilla Ice Cream in the U.S. between April 21, 2016, and August 14, 2024. Qualifying products include:
- Breyers Natural Vanilla Ice Cream in all sizes
- 1.5-quart (1.41L) carton
- 16-oz carton
- 10-pack of 3-oz cups
This applies to all packaging and labeling variations used during the specified period.
Potential Payout
You can receive $1.00 for each product purchased, with no limit if you provide proof of purchase. Without proof, you can claim up to 8 products (maximum payout of $8).
Filing a Claim
Claims can be submitted online through the settlement website or by mailing a claim form by February 19, 2025.
Proof of Purchase
No proof of purchase is required to file a claim. However, providing it allows you to claim more products beyond the 8-product limit for claims without documentation.
