Overview
Individuals who lived at Pathfinder Village Apartments in Fremont, California, and paid an allegedly unlawful rent increase or late fee between August 27, 2017, and May 3, 2022, may be eligible to receive a cash payment from a class action settlement.
Aimco Pathfinder Village Apartments LP and related defendants have agreed to pay $275,000 to resolve a lawsuit alleging they charged tenants illegal rent increases and late fees, violating the City of Fremont’s Rent Review Ordinance and California law.
Who is eligible
You may be part of the settlement if:
- You lived at Pathfinder Village Apartments, located at 39800 Fremont Blvd., Fremont, CA 94538, at any point between August 27, 2017, and May 3, 2022.
- You paid a rent increase or late fee that is alleged to be unlawful during that time.
This settlement applies to both single and multi-tenant households. If more than one tenant was on the lease, all are considered members of the class. Households may have claims for rent increases, late fees, or both.
Settlement fund distribution
The total settlement fund is $275,000. After deducting attorney fees, administrative costs, and a service award for the lead plaintiff, the remaining amount will be distributed among eligible class members.
Distribution of the net fund is as follows:
- 88.37 percent for unlawful rent increase claims
- 11.63 percent for unlawful late fee claims
Each class member’s share will be determined on a proportional basis, depending on how much they paid in rent increases or late fees compared to the total claimed by all class members.
If the total approved claims exceed the fund, payments will be reduced proportionally. Any unclaimed funds (such as uncashed checks) will be donated to court-approved nonprofit organizations.
No action is required to receive payment
Eligible class members do not need to submit a claim form. Payments will be mailed automatically to the last known address on file.
