Akumin Operating Corp. Data Breach Class Action Settlement


U.S. residents whose personal information may have been compromised in the Akumin Operating Corp. data breach on October 11, 2023, and who received notice of the incident, may be eligible to receive up to $2,500 in cash reimbursement and/or one year of free medical data monitoring through a class action settlement.

Akumin has agreed to resolve a lawsuit that alleged the company failed to adequately secure private information, leading to the data incident. The company denies any wrongdoing but chose to settle to avoid continued litigation.

Who Is Eligible to File a Claim?
To qualify for benefits, you must meet the following criteria:

  • You are a living individual residing in the United States.
  • Your personal information was potentially affected by the data breach that occurred on October 11, 2023.
  • You received a notification from Akumin about the incident.

Types of Information That May Have Been Compromised
The data potentially exposed in the breach includes:

  • Name
  • Home and email addresses
  • Date of birth
  • Social Security number
  • Driver’s license or passport number
  • Medical record number, Medicare/Medicaid ID, or other patient identifiers
  • Financial account or payment card information
  • Diagnosis, treatment, or imaging data
  • Occupational health or biometric information
  • Medical history, billing, or insurance claims information
  • Health insurance policy or subscriber numbers
  • Electronic signatures

What Can Class Members Receive?
Eligible individuals may claim one or both of the following:

  1. Up to $2,500 in Cash Reimbursement for verified out-of-pocket losses related to the breach, including:
    • Unreimbursed fraud or identity theft losses
    • Credit freeze or unfreeze costs
    • Postage, copying, mileage, or notary fees
    • Credit monitoring or identity theft protection purchased due to the incident
    • Professional fees (e.g., legal or accounting services) related to identity theft
  2. One Year of Free Medical Data Monitoring through CyEx Medical Shield Complete. This service includes:
    • Monitoring by one credit bureau
    • Up to $1 million in identity theft insurance
    • Real-time alerts

How to Submit a Claim
You can file a claim in either of the following ways:

  • Online: Complete the claim form available on the settlement website.

Required Documentation
For reimbursement claims, you must provide documentation such as:

  • Receipts for credit freeze fees or monitoring services

  • Letters from financial institutions denying chargebacks
  • Invoices from professionals assisting with identity recovery

Personal declarations or affidavits are not enough on their own but may support your claim.

No documentation is needed if you are only claiming the free medical data monitoring benefit.

Payment and Benefit Delivery

  • If you claim cash reimbursement, you will receive an email with instructions to choose between electronic payment or paper check.
  • If you claim medical data monitoring, you will receive an email with your activation code and enrollment instructions.

Settlement Fund Details
The total settlement fund is $2,850,000, allocated as follows:

  • Up to $250,000 for administration costs
  • Up to $2,850,000 for attorneys’ fees
  • Up to $2,500 each for service awards to class representatives
  • Costs for providing medical data monitoring (based on number of claims)
  • Up to $1,500,000 for reimbursement to class members (pro rata reductions will apply if claims exceed this amount)

  • Final date to file a claim: November 30, 2025
  • Final date to opt out or object: November 30, 2025
  • Final approval hearing: December 15, 2025

When Will Payments Be Made?
Payments and benefits will be issued approximately 105 days after the court grants final approval and any appeals are resolved.
