The lawsuit addressed allegations of automated phone calls made to individuals regarding Allstate insurance products without their prior consent. Many of these calls were made to individuals who were listed on the Do Not Call (DNC) Registry, which is designed to prevent unsolicited sales calls.
The lawsuit claimed that these automated calls violated the Telephone Consumer Protection Act (TCPA), a federal law that restricts telemarketing practices and the use of automated dialing systems, prerecorded messages, and SMS texts. The TCPA includes requirements for identifying the business making the call and providing contact information within the message.
Who Qualifies for Payment?
The settlement is open to any person in the United States who:
- Received one or more calls from AGAX promoting Allstate products,
- Had those calls transferred to an Allstate agent,
- Was contacted between September 23, 2016, and October 1, 2021,
- Had calls originating from leads sold by Phoenix to Overstep.
How to File a Claim
Eligible Settlement Class Members who submit a valid Claim Form will receive a check for $450. Claims could be submitted online until May 20, 2022.
The final approval hearing took place on August 15, 2022, at the U.S. District Court for the Southern District of Ohio.
