Overview
Build Realty Inc. and a group of related entities have agreed to a $1.3 million class action settlement to resolve allegations that they violated the federal RICO Act and breached fiduciary duties in connection with a property-flipping business operating in Ohio and Kentucky.
Eligible investors who participated in real estate transactions involving trusts managed by these entities may qualify to receive compensation of up to $20,000.
Who Is Eligible?
To qualify for a payout, individuals or businesses must meet all of the following criteria:
- Invested in real estate located in Ohio or Kentucky.
- Were named as a beneficiary of a trust created through a transaction involving Build Realty or any of the listed related entities.
- The investment took place between February 1, 2013, and May 24, 2019.

How Much Will Claimants Receive?
Eligible claimants may receive between $1,600 and $20,000, depending on the total number of valid claims submitted. Payments will be distributed on a pro rata basis.

Why Was This Lawsuit Filed?
The lawsuit alleged that Build Realty Inc. and its affiliates operated a property investment scheme that violated the Racketeer Influenced and Corrupt Organizations (RICO) Act and breached fiduciary duties by mismanaging investor interests in real estate trusts. Although the defendants deny any wrongdoing, they agreed to settle to avoid the uncertainty and cost of continued litigation.
