What Is This Settlement About?

Consumers who ordered Chipotle directly through the Android or iPhone app or via their website may be eligible for compensation due to a recent lawsuit concerning Chipotle’s delivery fees. The lawsuit claims that Chipotle provided false or misleading information about its delivery and service fees as well as menu prices.

How Do I Qualify?

You may qualify for a cash payment if you placed a food delivery order through Chipotle’s App or Website between May 11, 2020, and January 19, 2022. The settlement includes two subclasses:

  • Non-Rewards Member Subclass: U.S. consumers who were not members of Chipotle’s Rewards Program and placed food delivery orders through the app or website during the class period, and who were charged a service fee or higher menu prices.
  • Rewards Member Subclass: U.S. consumers who were members of Chipotle’s Rewards Program and ordered food delivery through the app or website during the class period, and who were charged a service fee or higher menu prices.

What Can I Get?

For Non-Rewards Subclass Members, a $1,000,000 fund has been established. This fund will first cover the costs of the Notice Plan and Claims Process, with any remaining funds distributed equally among Non-Rewards Subclass Members who submit valid claims.

For Rewards Subclass Members, the settlement offers vouchers for one free entrée from the Chipotle menu, with a total value not exceeding $3,000,000. Chipotle is not obligated to honor any reimbursement claims from Rewards Subclass Members once the total value of vouchers issued reaches $3,000,000, calculated using an average entrée value of $8.50.

How Do I File a Claim?

To qualify for compensation, either as a Non-Rewards or Rewards Class Member, you must complete and submit a Claim Form.

Once the Settlement Administrator reviews your Claim Form, they will confirm your eligibility for a cash payment. If approved, Non-Rewards Class Members will receive an email with instructions for obtaining a digital payment. Rewards Subclass Members will receive a redemption code via email for a free regularly priced entrée.

If you did not receive a Notice indicating your participation in the Settlement Class, which includes a 10-character alphanumeric “Unique ID,” please contact the Settlement Administrator at 1-855-675-3034 (Toll-Free).

A Final Approval Hearing will take place on July 12, 2022, at 10:00 a.m. at the Superior Court of the State of California in Oakland, California. Please note that the settlement is now closed to new claims.
