Duffy’s $500,000 Wage and Hour Class Action Settlement



Duffy’s HR Inc. and Duffy’s Holdings Inc. have agreed to a $500,000 class action settlement to resolve claims that the company failed to pay minimum wages to certain tipped employees and did not provide the required notice about the use of a tip credit under Florida law.


Who Is Eligible?

You may qualify for a payment if you:

  • Worked at Duffy’s located at 1804 Cordova Road, Fort Lauderdale, FL 33316
  • Held one or more of the following positions:
    • Server
    • Bartender
    • Barback
    • Busser
    • Front-of-house trainee
    • Food runner
    • Host (front door)
    • To-go server
    • Server assistant
    • Service bartender
  • Were employed between June 19, 2019, and June 30, 2024
  • Were paid at a tip credit rate (less than the full Florida minimum wage)
  • Did not receive proper notice that a tip credit would be taken against your wages

Eligibility is based on Duffy’s employment records. Individuals who received a notice by mail are presumed to be potential class members.


How Much Can Class Members Receive?

Payments will be distributed on a pro rata basis from the $500,000 settlement fund. The amount each class member receives depends on:

  • The number of hours worked at a tip credit rate
  • The number of valid claims submitted

Each eligible person’s payment will be split into two parts:

  • 50% will be treated as W-2 wages, subject to tax withholding
  • 50% will be treated as 1099 income, not subject to payroll taxes

How to Submit a Claim

To receive payment, eligible class members must:

Information Required to File a Claim

  • The eight-digit claim number and four-digit PIN found on your mailed claim form
  • If you did not receive a form or lost your ID or PIN, contact the settlement administrator at 866-602-2260 or use the “Contact Us” form on the settlement website

Payment Method

Payments will be mailed by check to the address provided on the claim form.


Settlement Fund Allocation

The $500,000 fund will be used for:

  • Administration costs: $6,350.64
  • Attorneys’ fees and costs: Up to $166,650
  • Service award to the named plaintiff: Up to $10,000
  • Remaining amount: Distributed to class members

Uncashed checks after 120 days will revert to Duffy’s.

When Will Payments Be Issued?

Payments will be distributed once the court grants final approval of the settlement and any appeals are resolved.


Why Was There a Lawsuit?

The lawsuit claimed that Duffy’s failed to comply with wage laws by:

  • Paying certain tipped employees below the full minimum wage
  • Not providing proper legal notice about taking a tip credit

While denying wrongdoing, Duffy’s agreed to settle the case to avoid further litigation costs and risks.
