What’s the Ford Class Action Lawsuit About?

A class action lawsuit has been settled concerning allegations that Ford sold defective 2016 and 2017 Ford Explorers. The claimed defect involves exhaust fumes entering the passenger compartment of certain Explorer vehicles.

How Do I Qualify for Payment?

Individuals in the United States (including Puerto Rico, territories, and Washington D.C.) who currently own or lease, or who previously owned or leased, a 2016 or 2017 Ford Explorer (excluding the Police Interceptor Utility models) may qualify. Even if your warranty has expired, you could be eligible for reimbursement for repair costs.

How Do I File a Claim and Get Paid?

You may qualify for partial reimbursement of post-warranty repair costs if repairs were made after your warranty expired and you paid an authorized Ford dealer for parts and labor.

A TSB (Technical Service Bulletin) repair is a voluntary fix for issues related to fumes from Ford Explorer models. You may be eligible for partial reimbursement for post-warranty repair costs if they occurred within one of the following timeframes:

  • Within 4 years or 48,000 miles after the vehicle was put into service (whichever comes first), or
  • On or before November 11, 2021.

Reimbursement amounts for TSB repairs are as follows:

  • Up to $400 for inspection and sealing of gaps in the passenger compartment.
  • Up to $400 for installation of a modified exhaust system in vehicles with a normally aspirated 3.5-liter TiVCT engine.

These amounts can be combined for a single vehicle if both types of repairs were performed, even if done during separate visits, as long as they meet the time and mileage requirements.

To obtain partial reimbursement for post-warranty repair costs, you must submit a claim to the Settlement Claims Administrator within six months of the settlement’s effective date or within 120 days after the TSB repair, whichever is later.
