What Is the Gerber Settlement About?

Consumers who purchased Gerber Good Start Gentle (GSG) infant formula in Florida or New York between October 10, 2011, and April 23, 2016, may qualify for a cash payment of up to $80 per household.

The class action alleged that Gerber falsely marketed GSG as capable of reducing the risk of allergies, including atopic dermatitis, and falsely implied FDA endorsement. Gerber denies all allegations but agreed to settle to avoid ongoing litigation costs.


Who Qualifies?

You’re eligible if you:

  • Purchased Gerber Good Start Gentle infant formula (not for resale)
  • Made the purchase in Florida or New York
  • Bought it between October 10, 2011 – April 23, 2016
  • Did not receive the product through WIC or Food Stamps

How Much Can You Receive?

Without Proof of Purchase:

  • Florida residents: $3 per unit, up to 5 units ($15 max)
  • New York residents: $4 per unit, up to 5 units ($20 max)

With Proof of Purchase:

  • Florida: $3 per unit, up to 20 units ($60 max)
  • New York: $4 per unit, up to 20 units ($80 max)

Maximum payout: $60 for Florida purchases, $80 for New York

  • Your relationship to the infant
  • State where the formula was purchased

If You Have Proof of Purchase:

  • Upload receipts, invoices, credit/debit card records, or similar documents
  • You may also need to show proof of residency in Florida or New York if you now live elsewhere
