What is the Smashburger Class Action?
A $4 million class action settlement has been reached with Smashburger over claims of false and misleading advertising. Founded in 2007, Smashburger operates hamburger restaurants across 35 U.S. states, with over 220 locations as of 2018.
The settlement includes a cash fund of $2.5 million and 1.5 million vouchers for consumers affected by misleading advertisements. The lawsuit claimed that a 2017 marketing campaign misrepresented burgers as containing “three times” the cheese and “twice the beef.” Specifically, it focused on the “triple doubles,” like the “Triple Double” and “Bacon Triple Double” burgers. Affected customers can choose between a cash reward or product vouchers.
What Can I Receive from the Smashburger Settlement?
If you qualify, you may receive one of the following rewards:
- A $4.00 cash reward for each eligible hamburger or cheeseburger purchased, with a maximum payout of $20.00 per household. Note that the final amount may decrease if more claims are filed than anticipated.
- Alternatively, you can opt for up to 10 vouchers (one for each eligible purchase) redeemable at Smashburger for either a single beef hamburger upgrade to a double or an additional small fountain drink with the purchase of a regular entrée.
No proof of purchase is needed to file a claim, but the class action administrator reserves the right to contest any claims they consider invalid, fraudulent, or late. By filing, you attest under penalty of perjury that you purchased eligible Smashburger products during the specified timeframe.

You qualify if you are a U.S. resident who purchased any of the following Smashburger hamburgers between July 1, 2017, and May 31, 2019:
