Former residents of Lake Pointe Assisted Living—or their legal representatives—may be eligible to receive a cash payment from a $1 million class action settlement.
The lawsuit alleged that Lake Pointe Assisted Living Inc. and Tony Bigler violated North Carolina’s Unfair and Deceptive Trade Practices Act by failing to provide adequate staffing and nutrition in accordance with state regulations. The defendants have agreed to pay $1 million to resolve the claims without admitting wrongdoing.
Who Is Included in the Settlement?
The settlement class includes:
- All individuals who resided at Lake Pointe Assisted Living between December 1, 2014, and October 18, 2018
- Legal guardians or powers of attorney for residents who were legally incompetent
- Heirs of deceased residents
- Identified responsible parties for class members
- Court-appointed administrators, executors, or personal representatives of deceased class members’ estates
If you received a notice about the settlement, you are likely included in the class.

No Claim Form Required
Eligible class members do not need to submit a claim form to receive a payment. Payments will be mailed to the address where the notice was sent.
If a class member wishes to:
- Update their mailing address
- Choose a digital payment method
- Provide a Social Security number or employer identification number for tax reporting purposes
They may do so by submitting an online form or mailing a completed PDF form to the settlement administrator. The notice ID and confirmation code are required for access.

Why Was This Lawsuit Filed?
The lawsuit claimed that Lake Pointe Assisted Living failed to meet staffing and nutrition standards required by North Carolina law. The facility was accused of providing substandard care to residents during the covered period.
