LoanCare, LLC and Fidelity National Financial, Inc. have agreed to a $5.9 million settlement to resolve a class action lawsuit stemming from a data breach that may have exposed the personal information of thousands of individuals.

If you received a notice from either LoanCare or Fidelity National Financial informing you that your data may have been compromised in a cybersecurity incident around November 19, 2023, you may be eligible to claim compensation of up to $5,000.

Available Settlement Benefits

Cash Payment A – Reimbursement for Losses

Eligible class members may claim:

  • Up to $1,500 for Ordinary Losses, including:
    • Credit monitoring expenses
    • Overdraft or late fees
    • Unauthorized charges
    • Other documented out-of-pocket costs due to the breach
  • Up to $5,000 for Extraordinary Losses, such as:
    • Identity theft-related financial losses
    • Fraud-related costs that exceed ordinary loss limits
    • These claims must include clear documentation and be directly linked to the data breach

Cash Payment B – Flat Rate

If you do not submit a claim for specific losses, you may instead request a flat cash payment of $100.

Credit Monitoring Services

All class members can opt for three years of credit and identity monitoring, including:

  • Credit file monitoring
  • Dark web monitoring
  • $1 million in identity fraud insurance
  • Access to fraud resolution services

Those who previously enrolled in LoanCare’s 24-month protection offer will receive an extra 12 months of monitoring.

  • Attorneys’ fees and expenses: Up to $1,966,470.66
  • Credit/identity monitoring costs: Based on the number of claimants
  • Remaining funds: Distributed to approved claimants

  • Final approval hearing: September 4, 2025

When Will Payments Be Made?

Payments will be sent out after the court grants final approval of the settlement and any appeals are resolved. The final hearing is scheduled for September 4, 2025.


Why Was This Lawsuit Filed?

The class action alleged that a cybersecurity breach on or around November 19, 2023, exposed sensitive personal data due to inadequate data security measures by LoanCare and Fidelity National Financial. The compromised information may have included names, addresses, Social Security numbers, and loan account numbers.

The defendants deny any wrongdoing but agreed to the settlement to avoid further litigation.
