Patients or employees of Medical Center Barbour affected by the October 2023 data breach may be eligible to claim up to $5,000 from a class action settlement.
Current and former patients or employees whose personal information may have been exposed in the incident could qualify to submit a claim. An estimated 61,014 individuals are included in the settlement.
Medical Center Barbour, Blue Management Services LLC (Alliant Management Services) and The Health Care Authority of the City of Eufaula agreed to settle a lawsuit alleging they failed to adequately safeguard personal and health information, resulting in the 2023 breach.
Who Is Eligible?
You may file a claim if:
- Your personally identifiable information or protected health information may have been accessed during the October 29, 2023 data incident
- You received a data breach notice from Medical Center Barbour in or around August 2024
- You are a current or former patient or employee of Medical Center Barbour
How Much Can Class Members Receive?
Eligible individuals may claim one or more of the following:
Expense reimbursement (up to $5,000):
For documented out-of-pocket losses related to the breach, including:
- Credit report fees
- Fees for freezing or unfreezing credit
- Card replacement fees
- Late fees
- Credit monitoring purchased due to the incident
- Other documented expenses directly related to identity theft or fraud
Class members applying for reimbursement may also claim up to three hours of lost time at $25 per hour (maximum $75).
Alternative cash payment:
Class members not submitting an expense claim may receive a pro rata cash payment estimated at $50. Final amounts depend on the number of valid claims.
Credit monitoring:
All class members may elect two years of free credit monitoring.

Settlement Fund Breakdown
The settlement establishes a $300,000 fund that includes:
- Credit monitoring costs (varies by number of claims)
- Payments to approved claimants (remaining funds up to $300,000)
The defendants will separately pay:
- Settlement administration costs (estimated $65,000)
- Attorneys’ fees and costs (up to $300,000)
- Service awards ($1,500 each to three representatives)

When Will Payments Be Issued?
Payments and credit monitoring activation codes will be distributed approximately 75 days after final court approval, or 30 days after individual claim approval, whichever is later.
Why Was This Settlement Reached?
The lawsuit alleged that a cyberattack on Medical Center Barbour in October 2023 exposed sensitive patient and employee information. Claims included negligence, breach of contract, breach of fiduciary duty, unjust enrichment and invasion of privacy.
The defendants deny wrongdoing but agreed to settle to avoid further litigation costs and risks.
