Mindpath Health $3.5M Data Breach Settlement

Individuals who received a notice from Mindpath Health regarding a 2022 data breach may be eligible to claim a cash payment or credit monitoring under a class action settlement.

Current and former patients who received notice of a data security incident in or around January 2023, or who received services from Mindpath before August 2022, may qualify to claim up to $50 or more. The lawsuit alleged that unauthorized parties accessed Microsoft Office 365 email accounts in March and July 2022, exposing personal and health information.

Who Is Eligible?

Class members qualify if all of the following apply:

  • Mindpath Health identified them as potentially affected by the March 2022 or July 2022 incidents
  • They received a data breach notice from Mindpath Health in or around January 2023
  • They are current or former patients who received services before August 2022

A California subclass also includes individuals who lived in California during at least one incident and received notice at a California address.

How Much Can Class Members Receive?

Ordinary documented losses:
Up to $1,500 for expenses caused by the data breach, such as:

  • Credit monitoring costs
  • Fees for freezing/unfreezing credit
  • Bank or credit card fees
  • Unreimbursed fraudulent charges

Lost time:
Up to 10 hours at $30 per hour (maximum $300), counted within the $1,500 ordinary-loss cap.

Extraordinary documented losses:
Up to $10,000 for major losses occurring between March 2022 and January 5, 2026, including:

  • Fraudulent tax returns
  • Loan fraud
  • Identity theft-related financial losses

Credit monitoring:
Three years of one-bureau credit monitoring.

Alternative pro rata cash payment:
Estimated at $50 for class members who choose cash instead of credit monitoring.

California subclass statutory payment:
Estimated at $50 for eligible class members residing in California at the time of the incident. This payment is automatic unless the person files a claim for other benefits.

How to File a Claim

Class members must submit a claim by January 5, 2026:

California subclass members who do not submit a claim for other benefits will automatically receive their statutory payment.

Required Documentation

  • Claimants filing by mail must include their unique claim form ID from the notice
  • Ordinary loss claims require documentation such as receipts, invoices, or statements
  • Extraordinary loss claims require more detailed proof, including police reports, attorney invoices, bank statements, or identity theft documentation
  • California residents who did not receive notice at a California address must contact the administrator with proof of residence

Settlement Fund Breakdown

The $3.5 million fund includes:

  • Settlement administration costs: Up to $202,900
  • Attorneys’ fees: $1,166,666.67
  • Attorneys’ expenses: Up to $35,000
  • Service awards: $5,000 each ($15,000 total)
  • Payments and credit monitoring: Remainder of the fund

  • Final approval hearing: February 19, 2026

When Will Payments Be Sent?

Payments will be issued approximately 60 days after final approval, assuming no appeals delay the process.

Why Did This Settlement Occur?

The lawsuit alleged that unauthorized parties accessed Mindpath Health’s Microsoft Office 365 email accounts in 2022, exposing sensitive personal and health data.
Mindpath Health denies wrongdoing but settled to avoid the risks and costs of further litigation.
