New York City has agreed to a $17.5 million settlement regarding the unlawful removal of religious head coverings during post-arrest photographs.

This settlement benefits individuals who were required to remove their religious head coverings while in the custody of the New York City Police Department (NYPD) between March 16, 2014, and August 23, 2021.

The class action lawsuit claims that the NYPD unlawfully removed religious head coverings from detained individuals for post-arrest photos, allegedly violating the First Amendment, the Religious Land Use and Institutionalized Persons Act, and state laws.

While New York City has not admitted to any wrongdoing, it has agreed to pay $17.5 million to resolve the claims.

Under the settlement terms, class members can receive $7,824 or more for each instance of unlawful removal, with the potential for higher payments depending on the number of valid claims submitted.

Note that liens for child support and certain debts owed to the New York City Department of Finance may be deducted from settlement payments.

The deadline for exclusion and objection is September 26, 2024, with a final approval hearing set for October 29, 2024.

To receive a payment from the New York City religious head covering settlement, class members must submit a valid claim form by September 26, 2024.
