Nuance Communications $8.5M MOVEit Data Breach Settlement



Overview

If you received a notice from Nuance Communications Inc. informing you that your personal data may have been compromised in the 2023 MOVEit security incident, you may be eligible to file a claim for up to $10,000 under a class action settlement.

Nuance Communications, a Microsoft company providing clinical support to healthcare organizations, has agreed to pay $8.5 million to resolve claims stemming from a cyberattack that occurred between May 27 and May 31, 2023. The breach allegedly exposed personal and protected health information of approximately 1.2 million individuals.


Who Is Eligible?

You may be part of the class if:

  • You received a notice from Nuance Communications about the 2023 MOVEit data breach.
  • Your information was contained in files compromised during the incident.
  • Notifications began being sent around September 15, 2025.

Settlement Benefits

Eligible class members can file claims for one or more of the following:

1. Credit Monitoring and Identity Protection

  • Two years of coverage, including medical data monitoring.

2. Reimbursement for Ordinary Losses (Up to $2,500)

Covers out-of-pocket expenses related to the data breach, such as:

  • Credit report access or freeze fees
  • Identity theft insurance purchased after May 31, 2023
  • Bank fees, postage, travel, or similar costs
  • Lost time: Up to $100 for 4 hours at $25/hour

3. Reimbursement for Extraordinary Losses (Up to $10,000)

Covers documented financial losses directly caused by fraud or identity theft linked to the breach. May include:

  • Fraudulent charges
  • Costs to recover stolen funds
  • Professional fees (e.g., legal or identity restoration)

4. Alternative Cash Payment

If you do not file for ordinary or extraordinary losses, you can request a pro rata cash payment, currently estimated at $100. Final amounts may vary depending on the number of claims, with a maximum of $1,000 per claimant.

Required Documentation

  • Ordinary and extraordinary losses: Receipts, bank or credit card statements, invoices, police reports, or other documentation may be required.
  • Lost time: Provide a written explanation of how time was spent addressing the breach.

Payment Methods

You may choose:

  • Digital payment (email and phone number required)
  • Paper check (mailed to the address on your claim form)

Settlement Fund Details

The $8.5 million fund will be used to cover:

  • Settlement administration: At least $550,000
  • Attorneys’ fees: Up to $2,805,000
  • Attorneys’ expenses: Amount to be submitted for court approval
  • Service awards: Not to exceed $2,500 per class representative
  • Credit monitoring: Cost depends on number of claimants
  • Payments to claimants: Remaining funds will be distributed among valid claims

No funds will revert to Nuance.

When Will Payments Be Made?

Payments and credit monitoring activation codes are expected to be issued approximately 90 days after final court approval and resolution of any appeals.


Why Was This Settlement Reached?

The class action lawsuit alleges that Nuance Communications failed to implement reasonable cybersecurity measures to prevent unauthorized access during the MOVEit file transfer breach. The plaintiffs claim the breach exposed sensitive personal and medical information.

Nuance denies all allegations but agreed to settle to avoid prolonged litigation and associated costs.
