Pacific Guardian Life Insurance $2M Data Breach Settlement

Consumers notified by Pacific Guardian Life Insurance Co. Ltd. that their personal information may have been compromised in an August 2023 cybersecurity incident may be eligible to receive up to $2,020 from a $2 million class action settlement.

Pacific Guardian Life Insurance Co. Ltd. agreed to pay $2 million to resolve claims that a data breach exposed sensitive personal information, including names, Social Security numbers, financial and payment card data, dates of birth and medical information. The lawsuit alleged negligence, breach of implied contract, unjust enrichment, invasion of privacy and violations of Hawaii law.


Who Is Eligible

Eligible individuals must have received a data breach notification letter from Pacific Guardian Life Insurance Co. Ltd. stating that the August 2023 cybersecurity incident may have exposed their private information.

The settlement excludes all federal, state and local government entities and their subdivisions.


Settlement Benefits

Class members may qualify for one or more of the following benefits:

Expense Reimbursement:
Up to $2,000 for documented, unreimbursed out-of-pocket expenses directly related to the data breach. Eligible costs include:

  • Credit reports, credit freezes and card replacement fees
  • Late or overdraft fees, loan interest and related charges
  • Bank or credit card fees
  • Postage, mileage and other incidental expenses
  • Up to one year of credit monitoring or identity theft insurance

Alternative Cash Payment:
Class members who do not seek reimbursement may instead claim an alternative payment of up to $50.

California Confidentiality of Medical Information Act (CMIA) Payment:
Class members who lived in California at the time of the data breach may claim an additional $20.

Credit Monitoring:
All class members are eligible for two years of free credit monitoring regardless of which cash benefit they select.


How to File a Claim

Class members can submit a claim online or by mail. The claim deadline is December 21, 2025.

Required Documentation

To claim expense reimbursement, claimants must provide receipts, statements or other non-self-prepared documents showing the expense and its connection to the incident. Handwritten or self-created documents are not sufficient on their own but may be submitted as supporting materials.

To claim the alternative cash payment, California CMIA payment and/or credit monitoring, class members only need to select the appropriate option.

All claims must include the unique ID number from the settlement notice. Online claimants must also provide the PIN listed in their notice.

Settlement Fund Allocation

The $2,000,000 settlement fund includes:

  • Attorneys’ fees and expenses: Up to $550,000
  • Service awards to class representatives: $2,500 each
  • Settlement administration costs: To be determined
  • Credit monitoring: Based on the number of valid claims
  • Payments to class members: Remaining balance

Important Dates

  • Exclusion (opt-out) deadline: November 21, 2025
  • Claim filing deadline: December 21, 2025
  • Final fairness hearing: January 13, 2026

Payout Schedule

Payments will be issued approximately 30 to 45 days after the court grants final approval and any appeals are resolved.
