What is This Settlement About?
A $267,359,000 settlement has been reached in a lawsuit against Rash Curtis and Associates, with $75,600,000 already recovered. The lawsuit alleges that Rash Curtis & Associates made calls to consumers using an autodialer or a prerecorded voice without prior consent, violating the Telephone Consumer Protection Act (TCPA). On May 13, 2019, the jury ruled in favor of the plaintiffs, determining that the defendant made 534,698 unlawful calls.
The TCPA restricts telemarketing and the use of automated dialing systems and prerecorded voice messages. It also sets forth requirements for identifying the business making the call.
How Do I Qualify?
You may qualify if you belong to one or more of the following classes:
- Skip-Trace Class 1: Anyone in the U.S. who received a call on their cellular phone from June 17, 2012, to April 2, 2019, from Rash Curtis’ DAKCS VIC dialer or Global Connect dialer, with their number obtained through skip tracing.
- Skip-Trace Class 2: Anyone in the U.S. who received a prerecorded message or robocall on their cellular or landline phone from June 17, 2012, to April 2, 2019, from Rash Curtis, with their number obtained through skip tracing.
- Non-Debtor Class 1: Anyone in the U.S. who received a call on their cellular phone from June 17, 2012, to April 2, 2019, from Rash Curtis’ DAKCS VIC dialer or Global Connect dialer, with their number obtained through skip tracing, and who never had a debt collection account with Rash Curtis.
- Non-Debtor Class 2: Anyone in the U.S. who received a prerecorded message or robocall on their cellular or landline phone from June 17, 2012, to April 2, 2019, from Rash Curtis, with their number obtained through skip tracing, and who never had a debt collection account with Rash Curtis.
What Can I Get?
The settlement fund allocated for qualifying class members is $46,421,474.20, distributed pro rata per call. Each eligible member is expected to receive a minimum of $86.82 per call received during the class period, averaging over $700 per member. More than 12,000 class members are projected to receive over $1,000, with some qualifying for payouts between $5,000 and $40,000. To receive payments exceeding $600, you must submit a Form W9 with your claim. This form is available on the class action administrator’s site.
