Individuals who received a notice that their personal information may have been compromised in the June 2023 Restek Corp. data breach may be eligible to receive up to $3,925 and/or free credit monitoring from a class action settlement.
Overview
Restek Corp. agreed to settle a class action lawsuit alleging that it failed to properly secure the personal information of certain current and former employees during a data breach that began on or around June 2, 2023. Compromised data may have included:
- Names
- Social Security numbers
- Dates of birth
- Driver’s license numbers
- Employer-issued ID numbers
- Passport numbers
- Financial information
- System access information
- Medical information
- Health insurance information
Who Is Eligible?
Class members must meet all of the following criteria:
- Reside in the United States
- Were identified by Restek as having personal information potentially compromised in the June 2023 data security incident
- Received an official notice from Restek about the incident
Settlement Payment Options
Class members may be eligible for multiple types of compensation:
Ordinary losses – up to $425
Reimbursement for documented, unreimbursed out-of-pocket expenses resulting from the breach, including:
- Attorney or accountant fees
- Credit repair services
- Credit freeze or unfreeze costs
- Postage or local travel expenses
- Credit reports, monitoring, or identity theft insurance purchased between December 5, 2023, and January 9, 2026
Lost time – up to $80
Reimbursement for up to four hours of lost time at $20 per hour. Lost time counts toward the $425 cap for ordinary losses.
Extraordinary losses – up to $3,500
Available for documented, unreimbursed monetary losses resulting from identity theft or fraud likely caused by the breach.
Alternative cash payment – $50
A one-time payment instead of pursuing claims for ordinary losses, lost time or extraordinary losses.
Credit monitoring
Two years of free identity protection through IDX, including:
- Single-bureau credit monitoring
- Dark web monitoring
- $1 million in identity theft insurance
- Identity recovery services
Important payment note: All monetary benefits for all class members combined are capped at $210,000. If approved claims exceed this amount, payments will be reduced proportionally.
How to File a Claim
Claims may be filed online or by submitting a printed claim form by mail. The deadline to file is January 9, 2026.

Required Documentation
- All claim types require the notice ID number and PIN from the mailed notice.
- Ordinary losses require third-party documentation such as receipts or statements.
- Lost-time claims require a written description and a sworn attestation.
- Extraordinary losses require proof of the financial loss, evidence of non-reimbursement, and a showing that the breach likely caused the incident.
- The $50 alternative cash payment requires no documentation.

Settlement Fund Allocation
The settlement fund will cover:
- Administration costs
- Attorneys’ fees, costs and expenses up to $130,000
- Service award of up to $2,500 for the class representative
- Credit monitoring costs based on the number of participants
- Monetary payments to class members, up to a total of $210,000

When Will Payments Be Issued?
Payments will be distributed once the court grants final approval and any appeals have been resolved.
Why the Settlement Was Filed
The lawsuit alleged that unauthorized individuals accessed Restek’s systems and files in June 2023, exposing sensitive employee information. Plaintiffs claimed the company failed to adequately protect this data. Restek denies all wrongdoing but agreed to settle to avoid the costs and risks associated with further litigation.
