What is the SmileDirectClub Settlement About?
This class action pertains to the closure of SmileDirectClub (SDC) and the compensation plan created for certain U.S. customers who were affected. On September 29, 2023, SmileDirectClub filed for Chapter 11 bankruptcy and halted operations on December 8, 2023. The compensation plan is designed to provide refunds and payment cancellations for customers enrolled in SmilePay installment plans who either did not receive their aligners or had incomplete treatment plans.
What is the Total Settlement Amount?
The total settlement amount for this plan is capped at $4,800,000.
Who Qualifies for a Payout?
To qualify for a payout, you must be a U.S. customer with an active Retail Installment Contract (RIC) with SmileDirectClub as of December 8, 2023. You should not have been delinquent on payments and were likely still in treatment for aligner therapy. Refunds or payment reductions are available to customers who did not receive their initial aligners or had incomplete treatment.
Who are HFD and SDC?
Healthcare Finance Direct (HFD) is a third-party payment processor that handles installment payments for U.S. and Canadian customers enrolled in SmilePay installment plans. HFD manages monthly payments, offers an online portal to track payment plans, and provides customer support during the financing process.
SmileDirectClub (SDC) was a company that provided dental aligner products and services. However, it filed for Chapter 11 bankruptcy on September 29, 2023, and announced the closure of its global operations on December 8, 2023. As of that date, SDC ceased providing dental aligners and services and discontinued its LifeTime Smile Guarantee. The bankruptcy cases were converted to Chapter 7 proceedings on January 26, 2024.
How Much Can I Get Paid?
The amount you can receive depends on your treatment status as of December 8, 2023:
- Customers within 30 days of treatment: You will automatically receive a refund for three installment payments ($267). You may also be eligible for additional refunds by submitting a Refund Request Form.
- Customers in treatment for more than 30 days: You will automatically receive a refund for one installment payment ($89) or a pro-rata RIC balance. Additional refunds may be available by submitting a Refund Request Form. The total refund is subject to the $4,800,000 cap, which could reduce the refund amount if the cap is exceeded.
How to File a Claim
To file a claim for the additional refund, complete and submit the Refund Request Form by March 11, 2025. This form was sent with the Notice of Claim to your most recent email address on file. If you didn’t receive it, contact HFD’s Customer Support Team.
