Sturm, Ruger & Co./Freestyle Software $1.5M Data Breach Settlement

Consumers whose personal information may have been compromised in the September 2020 data breach involving Sturm, Ruger & Co. Inc. and Freestyle Software Inc. may be eligible to receive a cash payment of up to $4,500 from a class action settlement.

The companies agreed to pay $1.5 million to settle claims that they failed to maintain adequate data security, leading to a breach that exposed sensitive customer information, including names, addresses, and payment details.

Who Is Eligible?

Class members include individuals who meet either of the following criteria:

  • They received a notice from Sturm, Ruger & Co. stating their information was affected by the breach.
  • Their personal information was exposed as part of the data incident, even if they did not receive a direct notification.

What Can Class Members Receive?

Eligible class members can request one or more of the following:

  • Out-of-pocket loss reimbursement: Up to $4,500 for documented expenses tied to the data breach, including identity theft losses, credit monitoring, account fees, notary or mailing costs, or professional services like legal or accounting fees.
  • Lost time compensation: Up to five hours at $25 per hour (maximum $125). This is included within the $4,500 cap.
  • Pro rata cash payment: A base payment of $50, which may increase to as much as $175 depending on how many valid claims are submitted. If total claims exceed available funds, payments will be reduced proportionally.

How to File a Claim

Class members can file online or download a PDF claim form, fill it out, and mail it to the administrator. The claim deadline is October 27, 2025.

Documentation Requirements

  • Online claims: Claimants must include the claim ID and PIN from their settlement notice.
  • Out-of-pocket losses: Must be supported with receipts, statements, or other documentation proving the expenses are tied to the data breach.
  • Lost time and base cash payments: No documentation is needed—just select the appropriate options on the form.

Settlement Fund Allocation

The $1.5 million fund will be used for:

  • Attorneys’ fees: Up to $500,000
  • Litigation costs: Up to $35,000
  • Service awards to class representatives: $3,500 each
  • Settlement administration costs: Amount to be determined
  • Payments to class members: Remaining funds after deductions

Key Dates

  • Deadline to opt out: September 29, 2025
  • Claim submission deadline: October 27, 2025
  • Final approval hearing: December 4, 2025

When Will Payments Be Made?

Payments to approved claimants will be issued about 90 days after the court grants final approval and any appeals are resolved.

Why Is There a Settlement?

The lawsuit alleged that Sturm, Ruger & Co. Inc. and Freestyle Software Inc. failed to implement sufficient cybersecurity measures, which allowed a data breach to occur in 2020. Plaintiffs claimed this breach exposed personal and payment information of customers.

Both companies deny the allegations but agreed to settle in order to avoid the burden and uncertainty of continued litigation.
