Sutter Health $21.5 Million Privacy Class Action Settlement

California residents who logged into their Sutter Health MyHealthOnline portal account between June 10, 2015, and March 20, 2020, for personal healthcare purposes may be eligible to receive up to $90 from a class action settlement. Approximately 1.6 million individuals are included in the settlement class.

Overview

Sutter Health has agreed to pay $21.5 million to settle claims that it improperly disclosed patients’ personally identifiable information (PII) and protected health information (PHI) to third parties such as Google and Meta. The lawsuit alleges that Sutter Health’s use of third-party tracking technologies on webpages—including the MyHealthOnline login page—violated California privacy laws.

Who Is Eligible?

To qualify for payment, individuals must meet all of the following criteria:

  • Logged into their own Sutter Health MyHealthOnline portal account
  • Login occurred between June 10, 2015, and March 20, 2020
  • Login was for personal healthcare use
  • Were a California resident at the time of login

Settlement Payment Amount

Class members may file a claim to receive a pro rata cash payment of up to $90. The exact amount depends on the total number of valid claims.

How to File a Claim

To receive payment, a claim form must be submitted by April 28, 2026. Claims may be filed in one of two ways:

Settlement Fund Details

The $21.5 million settlement fund will cover:

  • Settlement administration costs: approximately $385,000 to $445,000
  • Attorneys’ fees: up to $7,095,000
  • Attorneys’ expenses: estimated at $208,990.21
  • Service awards: up to $10,000 per class representative
  • Payments to class members with valid claims: remaining funds, up to $90 each

  • Exclusion deadline: January 23, 2026
  • Final approval hearing: February 27, 2026
  • Claim filing deadline: April 28, 2026

When Will Payments Be Sent?

Payments will be distributed approximately 150 days after the settlement receives final court approval and any appeals have been resolved.

Reason for the Settlement

The lawsuit alleged that Sutter Health violated the California Invasion of Privacy Act and breached contractual obligations by sharing patients’ information through third-party tracking and analytics tools. Sutter Health denies any wrongdoing but agreed to settle to avoid the uncertainty and expense of further litigation.
