Temecula Motorsports, Inc. (TMI) has agreed to a $1.45 million class action settlement resolving claims that it overcharged customers and failed to apply manufacturer rebates on new off-highway vehicle (OHV) purchases. Consumers who bought new OHVs from TMI between October 21, 2011, and October 20, 2015, may be eligible for a payment of up to $1,140.
What the Lawsuit Was About
The lawsuit alleged that TMI improperly charged customers excessive or undisclosed fees—including added dealer markups labeled as “Prep” charges—and failed to apply qualifying manufacturer rebates. Plaintiffs argued that these actions violated California’s consumer protection and advertising laws. TMI denies all wrongdoing but agreed to settle to avoid further litigation.
