Toshiba America Business Solutions, Inc. (TABS) has agreed to a $435,000 class action settlement following a data breach discovered on December 4, 2023, that exposed sensitive personal information—primarily names and Social Security numbers of current and former employees.

Impacted individuals who received a notification from TABS may qualify for up to $7,500 in compensation, with an additional $150 cash benefit for California residents.


Who Qualifies for Compensation?

You may be eligible if:

  • You are a current or former employee of TABS.
  • You received a mailed notice confirming your personal data was compromised in the December 2023 data breach.
  • Your name and Social Security number were accessed.
  • (For California residents) You received the breach notification at a California address.

Settlement Benefits

Class members may claim one or more of the following:

  • Out-of-Pocket Expense Reimbursement – Up to $7,500
    For documented, unreimbursed monetary losses directly related to the breach between Dec. 4, 2023, and Aug. 14, 2025. Must show reasonable efforts to prevent or recover the loss.
  • California Resident Payment – $150
    A flat cash payment available to qualifying California residents who were mailed breach notices at California addresses.
  • Pro Rata Cash Payment
    Any leftover funds after covering all valid claims will be split proportionally among class members who submit approved claims.

Required Documentation

To receive reimbursement for expenses:

  • Provide supporting documentation that losses were more likely than not caused by the breach.
    • Examples: receipts, invoices, identity theft service bills, or proof of fraud-related charges.

Affidavits alone are not enough but may be included to clarify supporting documents.


Payout Options


Settlement Fund Allocation

Total Settlement: $435,000, which will cover:

  • Attorney fees: Up to $145,000
  • Plaintiff service award: $5,000
  • Administrative costs: TBD
  • Payments to class members: Remaining funds after above expenses

When Will Payments Be Made?

Payments will be issued either:

  • 90 days after final court approval, or
  • Within 30 days of your claim being approved—whichever is later.

Why Was There a Settlement?

A class action lawsuit alleged TABS failed to properly protect employee data, allowing hackers to access sensitive information. TABS denies any wrongdoing but agreed to settle to avoid the costs and uncertainties of further litigation. As part of the settlement, TABS will also implement additional data security measures.
